Point Prime Recordings: Licensing Terms

Scope

These terms apply to licenses of music from the Point Prime Recordings catalog. The catalog includes works by the Label’s own core projects (orchestral/cinematic: point.prime; heavy: whose face is fire), producer xShin, and recording artists represented by the Label. Every synchronization, commercial placement, or instrumental lease is governed by these standardized conditions to protect both intellectual property rights and the creative integrity of our roster.

License Types

Point Prime Recordings offers three primary licensing tiers to accommodate different production scopes, budgets, and distribution channels:

  • A. Beat Lease: Non-exclusive licensing of instrumentals to vocalists and artists, securely transacted via Traktrain. All terms, usage limits, and rights allocations for this tier are detailed separately in the Beat Lease Terms.
  • B. Sync License: Commercial and non-commercial synchronization use of a master recording and/or underlying musical composition in film, television series, streaming platforms, advertising campaigns, promotional trailers, video games, and online video productions. Each synchronization license is issued in writing, explicitly outlining the designated title, media format, geographic territory, license term, and agreed fee.
  • C. Custom / Exclusive: Tailored agreements granting exclusive master rights, multi-track audio stems, bespoke custom compositions, or structural audio edits. These custom packages are negotiated individually and finalized via a written addendum.

Sync Licensing: How It Works

Synchronization licensing requires precise administrative clearance. Point Prime Recordings streamlines this process through transparent terms and comprehensive delivery standards:

  • One-Stop Clearance: For tracks explicitly designated as one-stop, the Label maintains full authority to clear both the master recording and the underlying musical composition in a single, unified license. For tracks not marked as one-stop, the Label explicitly defines which specific rights it holds and is authorized to grant.
  • Pricing Structure: Fees are quoted on a project-by-project basis, calculated according to the intended media type, geographic territory, license duration, and prominence of the musical use. Reduced rates are available upon request for low-budget independent projects and qualifying student film productions.
  • Audio Deliverables on Request: Licensees may request complete technical assets including the full mix, instrumental mix, isolated stems, targeted cut-downs (15, 30, and 60-second edits), alternative mixes, and seamless loop versions.
  • Metadata and Cue Sheets: Complete administrative documentation—including International Standard Recording Codes (ISRC), track split sheets, and cue sheet data—is provided with every issued license to facilitate proper broadcast reporting.
  • Credit Requirements: Licensees must display proper attribution in project end credits or media descriptions using the exact format: "[Track] by [Artist], licensed by Point Prime Recordings", unless an alternative credit format is specified in the written license agreement.
  • Content ID Management: Tracks licensed for synchronization are strictly exempt from automated Content ID monetization claims against the licensee’s approved production. Conversely, the Licensee is strictly prohibited from registering any licensed Point Prime Recordings track into third-party Content ID databases.

Restrictions

To protect artists and producers within the catalog, all licenses granted by Point Prime Recordings are subject to strict operational boundaries:

  • Resale, transfer, or sub-licensing of the master recordings or compositions is strictly prohibited.
  • Using catalog audio, stems, or master recordings for artificial intelligence training, machine learning dataset building, or voice/style cloning is strictly forbidden.
  • Music from the catalog must not be utilized within hateful, defamatory, obscene, or unlawful media productions.
  • Political campaigns, adult content, or highly controversial commercial themes require explicit prior written approval from the Label.

Ownership

Executing a license grants limited operational rights for use within specified media parameters; it never transfers underlying ownership of the master recording or musical composition. All rights holders—including the Label’s proprietary projects, independent artists, and producer xShin—retain full, unencumbered intellectual property ownership at all times.

Warranties and Liability

Point Prime Recordings warrants that it possesses the legal authority and necessary rights to grant each music license it issues, and confirms that featured tracks maintain proper clearances for underlying samples, loops, and co-written compositions. The Label’s total aggregate liability under any license agreement is strictly limited to the total financial license fee paid by the Licensee for that specific agreement.
