Licensing Terms

This Agreement is made between pointprimerecordings.com (“Licensor”) and the purchaser (“Licensee”). By purchasing a license from pointprimerecordings.com (facilitated via the Tracktrain platform), you automatically agree to the following terms and conditions.

1. Grant of License

The Licensor grants the Licensee Non-Exclusive Rights to use the musical instrumental (the “Beat”) to create a new musical composition/song.

2. License Types

A. Professional WAV Lease (Standard)

  • File Format: High-quality, uncompressed 24-bit WAV (Single Stereo Track). We do not provide MP3s to ensure professional production standards.
  • Recording Rights: Permitted for use in one (1) new recording (Vocals/Lyrics added).
  • Distribution Limit: Up to 100,000 audio streams (Spotify, Apple Music, SoundCloud, etc.).
  • Video: Unlimited Music Videos allowed on YouTube & Social Media with monetization enabled.
  • Radio: Non-commercial radio airplay is permitted.
  • Term: Perpetual (Life of the song).

B. Stems, Trackouts & Exclusive Rights

  • Custom Request Only: Separate audio tracks (Stems/Trackouts) and Exclusive Rights are not sold directly through the automated store.
  • Inquiry: To obtain individual stems for mixing or to secure full exclusive ownership (removing the beat from the store), the Licensee must contact the Licensor directly at info@pointprimerecordings.com.
  • Terms: Pricing and specific usage rights for Stems or Exclusives will be negotiated and provided in a separate written addendum.

3. Credit Requirement

The Licensee must credit the Licensor in all metadata, titles, and descriptions wherever the song is distributed or uploaded.

  • Format: “Prod. by Point Prime” or “Music by xShin”

4. Content ID & Copyright (IMPORTANT)

Since the Professional WAV Lease is a NON-EXCLUSIVE license, the Licensee is STRICTLY PROHIBITED from:

  1. Submitting the track to any Content ID system (YouTube Content ID, Facebook Rights Manager, Tunecore/Distrokid monetization, Identifyy, etc.). This prevents false copyright strikes against other artists who have legally leased the same beat.
  2. Reselling, transferring, or sub-licensing the beat file to third parties.
  3. Registering the instrumental with any Copyright Office. You own the copyright to your lyrics and melody only; the Licensor retains 100% ownership of the original instrumental composition.

5. Payment & Delivery

All transactions are securely processed through the Tracktrain marketplace. Upon successful payment, the Licensee will receive an automated download link to the high-quality 24-bit WAV file(s).

6. Ownership

The Licensor (pointprimerecordings.com) retains 100% copyright and ownership of the instrumental. The Licensor reserves the right to continue selling non-exclusive licenses for this beat to other artists until an Exclusive License is executed.
